Scope and Validity
These General Terms and Conditions of Sale (hereinafter referred to as “GTCS”) apply to all products delivered and services provided by Don Capa Sàrl – hereinafter referred to as “Don Capa” – ordered by the customer on the website www.doncapa.ch. They govern all commercial relationships between the customer and Don Capa, except where expressly agreed otherwise in writing. Any customer’s terms of purchase only bind Don Capa if they are expressly accepted in writing by Don Capa.
If any provisions are invalid or unenforceable, it does not affect the validity and enforceability of the other provisions. In such a case, the invalid provision must be interpreted or supplemented to achieve the intended regulatory objective as much as possible.
Data Protection
We will also use cookies to track the contents of your shopping cart while you browse our site. When you make a purchase from us, we will ask you to provide information such as your name, billing address, shipping address, email address, phone number, details of your credit card/payment, and optional account information like your username and password. We will use this information for purposes such as:
• sending you information about your account and order
• responding to your requests, including refunds and claims£
• processing payments and preventing fraud
• setting up your account for our store
• fulfilling any legal obligations we have, such as calculating taxes
• improving our store offerings
• sending you marketing messages, if you choose to receive them
If you create an account, we will store your name, address, email, and phone number, which will be used to fill out the checkout for future orders. We generally store information about you for as long as we need the information for the purposes for which we collect and use it, and we are not legally required to continue to keep it. For example, we will keep order information for 10 years for tax and accounting purposes. This includes your name, email address, and billing and shipping addresses. We will also store comments or reviews if you choose to leave them.
Don Capa complies with Swiss data protection laws.
In the course of billing, collection, or the performance of contractual services, Don Capa may share customer data with third parties.
Don Capa and its selected partners may use customer data for marketing purposes related to Don Capa’s services or products.
Conclusion of the Contract
The contract between the customer and Don Capa is concluded when the customer places an order on the website www.doncapa.ch, and it is accepted by Don Capa.
Don Capa accepts the order by sending the customer:
a. an order confirmation via email
b. by delivering the ordered products.
Prices
All prices on Don Capa’s website are in Swiss Francs (CHF), VAT included.
Ancillary costs such as packaging and shipping fees (freight and transport) are not included in the prices and are the responsibility of the buyer.
Unless otherwise indicated, accessories are not included in the price.
Don Capa reserves the right to adjust prices and services based on market conditions.
Delivery & Returns
After the order is validated, all ordered items are delivered to the delivery address provided by the customer. The delivery times indicated by Don Capa are provided for reference only, unless expressly stated otherwise in writing.Available items are shipped within approximately 2 to 8 days. We will do our best to ship products on time, but we cannot be held responsible for any failure to meet this date. You may be asked to contribute to the shipping costs once per order. For countries outside the EU / EFTA, Don Capa cannot guarantee the delivery time. You will receive an estimate of this time from the carrier when placing your order.
It is your responsibility to pay any customs duties or other fees incurred when importing these products into your country. As these fees and charges are subject to change, we recommend obtaining all necessary information before placing the order.
Don Capa does not deliver to P.O. boxes, minors, or any person under guardianship or trusteeship.
This applies particularly in case of delivery delays, such as due to supplier supply problems. Delivery delays do not entitle the buyer to any compensation against Don Capa. In the event of disruptions in operations, administrative measures, shortages of labor or raw materials, energy crises, force majeure, or other unforeseeable events such as strikes or lock-outs, which cannot be avoided despite reasonable precautions, Don Capa may cancel the order. Any desired modification or cancellation of the order by the buyer must be subject to a corresponding written agreement with Don Capa to be legally binding. The resulting costs are borne by the buyer. In the event of minor technical changes to the product between the order and delivery, the buyer is not entitled to terminate the contract.
Items must be returned intact and complete in their original packaging (with labels showing their references), accompanied by the delivery note, within 5 days after receiving the package. All return costs are at your expense.
Shipping Risk
The risk of loss of the ordered goods is transferred to the buyer as soon as Don Capa hands over the goods to the shipper.
When goods are handed over to the post, they are not systematically insured. If such a shipment is lost, Don Capa is not responsible for the shipment, the goods, or the contents of the shipment.
Warranty
Only product characteristics expressly designated as warranties in the written offer are considered as “warranties.” Don Capa is liable to the customer for damages proven to have been caused intentionally or through gross negligence. Any other liability, such as liability for indirect damages, liability for given advice, usage instructions or incorrect information, liability for data loss, or interruptions of service, is expressly excluded. Don Capa does not guarantee the continuous and uninterrupted availability of its services and disclaims any liability for interruptions or disruptions in operation.
