Scope and validity
These General Sales Conditions (hereinafter referred to as “GSC”) apply to all products delivered and services provided by Don Capa Sàrl - hereinafter referred to as “Don Capa” - ordered by the customer on the website www.doncapa.ch. They govern all commercial relations between the customer and Don Capa, unless explicitly agreed otherwise in writing. Any purchase condition emanating from the customer is only binding on Don Capa if Don Capa has expressly accepted it in writing.
If certain provisions are invalid or inapplicable, this does not affect the validity and applicability of the other provisions. In this case, the invalid provision must be interpreted or supplemented in such a way as to achieve as far as possible the intended regulatory objective.
Data protection
We also use cookies to track the contents of your shopping cart while you are browsing our site. When making a purchase, we will ask you to provide information such as your name, billing address, delivery address, e-mail address, telephone number, payment/bank card details and, possibly, account information such as a login and password. We use this information to :
- send you information about your account and your order;
- respond to your requests, including refunds and complaints;
- process payments and prevent fraud;
- create your account for our store;
- fulfill our legal obligations, such as calculating taxes;
- improve our store offers;
- send you marketing messages if you choose to receive them.
If you create an account, we will store your name, address, e-mail and telephone number to automatically fill in forms for future orders. We retain your information for as long as necessary to fulfill the purposes for which it was collected, unless we are legally obliged to retain it. For example, order information is kept for 10 years for tax and accounting purposes. This includes your name, e-mail address, billing and delivery addresses. We also store any comments or reviews you choose to leave.
Don Capa complies with Swiss data protection laws.
Don Capa may share customer data with third parties for billing, collection or contractual services.
Don Capa and its selected partners may use customer data for marketing purposes in connection with Don Capa's services or products.
Conclusion of contract
The contract between the customer and Don Capa is concluded when the customer places an order on the site www.doncapa.ch and the order is accepted by Don Capa.
Don Capa accepts the order by sending the customer: a. an order confirmation by e-mail ;
b. the products ordered.
Prices
All prices displayed on the Don Capa website are in Swiss francs (CHF), including VAT.
Ancillary costs such as packaging and delivery charges (freight and carriage) are not included in the prices and are to be borne by the purchaser.
Unless otherwise indicated, accessories are not included in the price.
Don Capa reserves the right to adjust prices and services according to market conditions.
Delivery and returns
Once the order has been validated, all items ordered are delivered to the address indicated by the customer.The delivery times indicated by Don Capa are given as an indication, unless expressly stated in writing.Available items are dispatched within approximately 2 to 8 days. We make every effort to meet these deadlines, but cannot be held responsible for delays.A contribution to shipping costs may be requested once per order. For countries outside the EU/EFTA, Don Capa does not guarantee delivery times. You will receive an estimate of these times from the carrier when you place your order.
It is your responsibility to pay any customs duties or other charges related to the import of products into your country.As these fees may vary, we recommend that you inquire before placing your order.
Don Capa does not deliver to P.O. Boxes, minors or persons under guardianship.
In the event of late delivery due to supply problems, the customer may not claim any compensation from Don Capa. In the event of force majeure or unforeseeable events (strikes, shortages, energy crises, etc.), Don Capa may cancel the order. Any modification or cancellation of the order by the purchaser must be agreed in writing with Don Capa in order to be legally valid, the resulting costs being borne by the purchaser.
Items must be returned intact and complete in their original packaging (including labels), accompanied by the delivery note, within 5 days of receipt. You are responsible for return shipping costs.
Shipping risks
The risk of loss of the goods ordered is transferred to the buyer as soon as Don Capa hands over the products to the carrier.
When parcels are handed over to the post office, they are not systematically insured.In the event of loss of a parcel, Don Capa declines all responsibility for the shipment, the goods or their contents.
Warranty
Only those product characteristics explicitly designated as guarantees in the written offer are considered as guarantees.
Don Capa is liable for proven damage caused intentionally or by gross negligence. All other liability, such as for indirect damage, loss of data or service interruptions, is excluded. Don Capa does not guarantee continuous and uninterrupted availability of its services and accepts no liability for interruptions in operation.
